Common use of Inspection by Landlord Clause in Contracts

Inspection by Landlord. Landlord shall have the right to inspect the Tenant Improvements at all times, provided however, that Landlord’s failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s rights hereunder nor shall Landlord’s inspection of the Tenant Improvements constitute Landlord’s approval of the same. Should Landlord disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by Tenant, Landlord shall notify Tenant in writing of such disapproval, shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such Tenant Improvements shall be promptly rectified by Tenant at no expense to Landlord.

Inspection by Landlord. Landlord shall have the right to inspect the Tenant Improvements at all times; provided, provided however, that Landlord’s failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s rights hereunder under this Tenant Work Letter or this Lease, nor shall Landlord’s inspection of the Tenant Improvements constitute Landlord’s approval of the same. Should Landlord disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by TenantImprovements, Landlord shall notify Tenant in writing of such disapproval, disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such in, and/or disapproval by Landlord of, the Tenant Improvements shall be promptly rectified by Tenant at no expense to LandlordLandlord within thirty (30) days.

Inspection by Landlord. Landlord shall have the right to inspect the ---------------------- Tenant Improvements at all times, provided however, that (i) Landlord shall not unreasonably interfere with Tenant's construction of the Tenant Improvements in connection with any such inspection, and (ii) Landlord’s 's failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s 's rights hereunder nor shall Landlord’s 's inspection of the Tenant Improvements constitute Landlord’s 's approval of the same. Should Landlord reasonably disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by TenantImprovements, Landlord shall notify Tenant in writing of such disapproval, reasonable disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such in, and/or disapproval by Landlord of, the Tenant Improvements shall be promptly rectified by Tenant at no expense to Landlord.

Inspection by Landlord. Tenant shall use commercially reasonable efforts to provide Landlord with reasonable prior notice of any inspection to be performed by a governmental entity in connection with the construction of the Tenant Improvements in order to allow Landlord to be present during such inspection. Landlord shall have the right to inspect the Tenant Improvements at all times, provided however, that Landlord’s failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s rights hereunder nor shall Landlord’s inspection of the Tenant Improvements constitute Landlord’s approval of the same. Should Landlord reasonably disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by TenantImprovements, Landlord shall notify Tenant in writing of such disapproval, disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such in, and/or reasonable disapproval by Landlord of, the Tenant Improvements shall be promptly rectified by Tenant at no expense to Landlord.

Should Landlord disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by Tenantdue to material nonconformance with the Approved Construction Documents, Landlord shall notify Tenant in writing of such disapproval, disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such in, and/or disapproval by Landlord of, the Tenant Improvements shall be promptly rectified by Tenant as soon as reasonably possible after notification from Landlord at no expense to Landlord.

Inspection by Landlord. Landlord shall have the right to inspect the Tenant Improvements at all reasonable times, accompanied by Tenant’s representative, provided however, however that LandlordLandlord shall comply with the contractor’s failure to inspect the Tenant Improvements access and work rules and shall in no event constitute a waiver of any of Landlordnot unreasonably interfere with Tenant’s rights hereunder nor shall Landlord’s inspection construction of the Tenant Improvements constitute Landlord’s approval of the samein connection with any such inspection. Should Landlord reasonably disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by TenantImprovements, Landlord shall notify Tenant in writing of such disapproval, reasonable disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any reasonable defects or deviations in such in, and/or disapproval by Landlord of, the Tenant Improvements (other than cosmetic comments) shall be promptly rectified by Tenant at no expense to Landlord. Landlord shall not be entitled to any review, oversight or administrative fee in connection with construction of the Tenant Improvements.

Inspection by Landlord. Landlord shall have the right to inspect the Tenant Improvements at all times, and provided further that Landlord shall not unreasonably interfere with the performance of the Tenant Improvements, provided however, that Landlord’s 's failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s 's rights hereunder nor shall Landlord’s 's inspection of the Tenant Improvements constitute Landlord’s 's approval of the same. Should Landlord disapprove (due to defects in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by TenantImprovements, Landlord shall notify Tenant in writing of such disapproval, disapproval and shall specify the items disapproved, and shall identify with reasonable specificity the grounds for such disapproval. Any defects in, or deviations in such from the Approved Working Drawings by the Tenant Improvements Improvements, shall be promptly rectified by Tenant at no expense to Landlord.

Inspection by Landlord. Tenant shall provide Landlord with reasonable prior notice of any inspection to be performed by a governmental entity in connection with the construction of the Tenant Improvements in order to allow Landlord to be present during such inspection. Landlord shall have the right to inspect the Tenant Improvements with Tenant at all timesreasonable times following reasonable advanced notice, provided however, that Landlord’s 's failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Landlord’s 's rights hereunder nor shall Landlord’s 's inspection of the Tenant Improvements constitute Landlord’s 's approval of the same. Should Landlord disapprove (due to defects and Tenant identify any defect in the construction of the same, or material deviation from the specifications and requirements therefore set forth in the Final Working Drawings) any portion of the Tenant Improvements being constructed by Tenantin connection with any such inspection, Landlord and Tenant shall notify Tenant in writing of document such disapproval, shall specify the items disapproveddefect, and shall identify with reasonable specificity the grounds for such disapproval. Any defects or deviations in such Tenant Improvements defect shall be promptly rectified by Tenant at no expense to LandlordLandlord (except to the extent of any remaining Tenant Improvement Allowance).
