Common use of Information and Technical Advice Clause in Contracts

Information and Technical Advice. 1. Only under special circumstances may the Arbitration Tribunal seek the opinion of experts or information from any relevant source. Before the Arbitration Tribunal seeks such information or advice it shall inform the parties and provide them with duly justified reasons for doing so. Any information obtained in this manner must be disclosed to both parties. The expert’s opinion shall be non-binding.
