Common use of INDOT Repairs Clause in Contracts

INDOT Repairs. INDOT shall not be required to make any repairs to the Site (other than to State Improvements or any State owned Fiber Optic cable) unless such repairs shall be necessitated by reason of the default or neglect of INDOT. If Operator fails to make necessary repairs to the Site and/or Improvements, it shall be considered a default under Section 5.2.
