Indemnity and reimbursement payments exclude input tax credit entitlements. If one party (payer) is required to indemnify or reimburse another party (payee) for any cost, loss or expense incurred by the payee, the required payment does not include any part of such cost, loss or expense that the payee (or an entity grouped with the payee for GST purposes) is entitled to claim as an Input Tax Credit, but will be increased under clause 8.1 if the payment is consideration for a Taxable Supply.
