Inappropriate Personal Conduct. (a) Inappropriate conduct means "unwelcome" or "unwanted" verbal or physical behaviour that is non-discriminatory in nature, directed at a person or specific group of people, which causes substantial distress in that person or group of people and serves no legitimate work-related purpose. As well, improper personal conduct does not include action occasioned through the exercise, in good faith, of the Employer's managerial/supervisory rights and responsibilities. In this context "unwelcome" or "unwanted" means any action which the respondent reasonably knows, or ought to know is not desired. Such behaviour could include but is not limited to:
