IMPROVEMENTS REQUIRED. A. All of the improvements required under these regulations, or improvements specified in the Future Land Use Plan of the City of Weston, or improvements which, in the judgment of the City Engineer, are necessary for the adequate provision of streets, utilities, drainage, services, and facilities to the subdivision and to surrounding areas of the City, shall be constructed at the sole expense of the developer, unless other provisions are approved by the City Council. Payment for any and all improvements which are not to be made at the time of the primary construction of the subdivision or development shall be made a part of a binding contract, signed by the developer and approved by the City Council. B. Any rebates or other payments to the developer by the City for the cost of oversized improvements or off-site improvements required as a part of the subdivision or development and necessary for the adequate and efficient development of surrounding areas of the City, shall be paid only from monies received by the City from the subdividing or development of surrounding areas, and such rebates or payments shall not be made until such monies are received by the City, unless other provisions are approved by the City Council.
