Common use of Hearing and Findings Clause in Contracts

Hearing and Findings. Upon such hearing both the appealing employee and the appointive authority whose action is reviewed shall have the right to be heard publicly and present evidence. At the hearing of such appeal, technical rules of evidence shall not apply. The Board of Directors shall, within five days after hearing, make a finding as to whether or not the employee was disciplined for reasonable cause and shall also make a determination as to the eligibility of the employee for future employment with the Yuba County Water Agency. A copy of the written findings of the Board of Directors shall be transmitted to the General Manager, the Power Systems Manager, and the employee. All of the records in the matter shall be remanded to the Secretary of the Board of Directors for filing. The Board of Directors may restore the employee's eligibility for employment in the appropriate classification of the Agency service or abrogate other disciplinary action if it deems such action advisable.
