Growing at authorized sites. If an inspector determines that any plants for planting, or any increase there- from, grown at a site specified in an authorized postentry quarantine grow- ing agreement is being grown contrary to the provisions of this section, in- cluding in numbers greater than the number approved by the postentry quarantine growing agreement, or in a manner that otherwise presents a risk of introducing quarantine pests into the United States, the inspector shall issue an emergency action notification (PPQ Form 523) to the person who signed the postentry quarantine grow- ing agreement. That person shall be re- sponsible for carrying out all actions specified in the emergency action noti- fication. The emergency action notifi- cation may extend the time for which the plants for planting and the increase therefrom must be grown under the postentry quarantine conditions speci- fied in the authorized postentry quar- antine growing agreement, or may re- quire that the person named in the no- tification must destroy, ship to a point outside the United States, or apply treatments or other safeguards to the plants for planting, the increase there- from, or any portion of the plants for planting or the increase therefrom, within the time specified in the emer- gency action notification. In choosing which action to order and in setting the time limit for the action, the in- xxxxxxx shall consider the degree of pest risk presented by the quarantine Animal and Plant Health Inspection Service, USDA § 319.40–1 pests associated with the type of plants for planting (including increase there- from), the types of other host mate- rials for the pest in or near the growing site, the climate and season at the site in relation to the pest’s survival, and the availability of treatment facilities.

  • Sites Sites shall mean the locations set forth in the Contract Documentation.

  • Notice to Proceed - Site Improvements The Recipient shall not commence, or cause to be commenced, any site improvements or other work on the Land until the Director has issued a Notice to Proceed to the Recipient. Such Notice to Proceed will not be issued until the Director is assured that the Recipient has complied with all requirements for the approval of a grant under Revised Code Sections 164.20 through 164.27 and has completed any land acquisition required by the Project.
