This clause is commonly used to provide certainty and stability for both parties, ensuring that key contractual elements remain consistent and are not subject to last-minute changes or disputes.
Freezing Point. This test is to detect added water. Nutritional problems can cause freezing points to rise, but not generally above - 0.5°C. With payments for composition, there is no incentive to add water to milk. We still test for ‘Added Water’ however as it can occur and is a risk to overall milk quality at the factory. Members will be notified of issues as they arise. If suppliers are found to have water in their milk, they may be subject to suspension until the issue is resolved.

FDA will not be responsible for payment of milk not collected or not utilised by FDA due to: Milk contamination as defined by these Conditions of Supply - • Inhibitory substancesMilk temperatureAdverse weather conditions • Where the farm has restricted access due to safety, or notified public health reasons – such as animal disease (botulism, FMD, Anthrax) etc. • Road access – specifically lack of adequate road access due to weather conditions: Farmers are reminded that they must have 24-hour, all-weather access and safe road access for milk tankers under all weather conditions to the dairy (see transport section 6 for further details). FDA strongly encourages suppliers to discuss with FDA Representative any suspect milk before pick-up and take advantage where necessary of the preliminary testing if advised to do so. FDA strives to remove the risk of contaminated milk entering the processing system. Inhibitory substances can include, but are not limited to: antibiotics, pesticides, herbicides, detergents (especially quaternary ammonium compounds), blood, and colostrum. These substances, especially antibiotics, can have extreme effects on the manufacturing processes. All tankers are AB tested upon arrival at a processing facility with subsequent additional testing for individual ▇▇▇▇▇▇’▇ milk if there has been a positive antibiotic result. The supplier will be penalised at the company’s discretion for any loads that fail the sensory test. By the 1st of June for the milk year commencing 1st July of the supply year, ▇▇▇▇▇▇ will announce the Opening Price for the year for all suppliers in the Southern Milk Region. The Opening Price provides a minimum monthly price for butterfat and protein across the year and is based on the supply of premium quality milk. Beston will pay for butterfat and protein at a ratio of 1:2.2 which is reflected in all milk pricing components in this Handbook.

  • Freezing a. This peril means freezing of a plumbing, heating, air conditioning or automatic fire protective sprinkler system or of a household appliance, but only if you have used reasonable care to: (1) Maintain heat in the building; or (2) Shut off the water supply and drain all systems and appliances of water. b. In this peril, a plumbing system or household appliance does not include a sump, sump pump or related equipment or a roof drain, gutter, downspout or similar fixtures or equipment.

  • Number Resources, Rate Center Areas and Routing Points 13.1 Nothing in this Agreement shall be construed to limit or otherwise adversely affect in any manner either Party’s right to employ or to request and be assigned any Central Office Codes (“NXX”) pursuant to the Central Office Code Assignment Guidelines and any relevant FCC or Commission orders, as may be amended from time to time, or to establish, by Tariff or otherwise, Rate Center Areas and Routing Points corresponding to such NXX codes. 13.2 It shall be the responsibility of each Party to program and update its own switches and network systems pursuant to information provided on ASRs as well as the LERG in order to recognize and route traffic to the other Party’s assigned NXX codes. Except as expressly set forth in this Agreement, neither Party shall impose any fees or charges whatsoever on the other Party for such activities. 13.3 Unless otherwise required by Commission order, the Rate Center Areas will be the same for each Party. During the term of this Agreement, Onvoy shall adopt the Rate Center Area and Rate Center Points that the Commission has approved for Frontier within the LATA and Tandem serving area. Onvoy shall assign whole NPA-NXX codes to each Rate Center Area unless otherwise ordered by the FCC, the Commission or another governmental entity of appropriate jurisdiction, or the LEC industry adopts alternative methods of utilizing NXXs. 13.4 Onvoy will also designate a Routing Point for each assigned NXX code. Onvoy shall designate one location for each Rate Center Area in which the Onvoy has established NXX code(s) as the Routing Point for the NPA-NXXs associated with that Rate Center Area, and such Routing Point shall be within the same LATA as the Rate Center Area but not necessarily within the Rate Center Area itself. Unless specified otherwise, calls to subsequent NXXs of Onvoy will be routed in the same manner as calls to ▇▇▇▇▇’s initial NXXs. 13.5 Notwithstanding anything to the contrary contained herein, nothing in this Agreement is intended, and nothing in this Agreement shall be construed, to in any way constrain Onvoy’s choices regarding the size of the local calling area(s) that Onvoy may establish for its Customers, which local calling areas may be larger than, smaller than, or identical to Frontier’s local calling areas.

  • Delivery Point The delivery point is the point of delivery of the Power Product to the CAISO Controlled Grid (the “Delivery Point”). Seller shall provide and convey to Buyer the Power Product from the Generating Facility at the Delivery Point. Title to and risk of loss related to the Power Product transfer from Seller to Buyer at the Delivery Point.

  • Reactivation To reactivate suspended Service, you must bring your account current through the month of reactivation by making payment in full of any outstanding balance, fees and other applicable charges. In addition, we may require a deposit before reactivating your Service. The amount of the deposit will not exceed one year of monthly fees. Any amounts deposited by you will appear on your statement as a credit, and service charges and other fees will be invoiced as described above. If you fail to pay any amount on a subsequent ▇▇▇▇, the unpaid amount will be deducted each billing cycle from the credit amount. Credit amounts will not earn or accrue interest.
