FACILITY RESPONSIBILITIES. a. The Facility will make available to Interns its facilities and staff as the Facility determines reasonable and appropriate to provide opportunities for educational experience related to the Fieldwork. b. The Facility will provide a variety of learning experiences appropriate to the setting. The experiences and skills taught to the Interns shall build upon their academic experience, apply generally to the field of nutrition , and shall not be specifically limited to the Facility’s practice or operation. c. The Facility, in coordination with the Academic Fieldwork Coordinator, will plan and implement a/an clinical nutrition education program for the Interns that meets the specific objectives of the clinical experience. d. The Interns will not replace, substitute for, or augment the work of paid employees of the Facility. (a) Facility shall provide Trainees with access to Interns its facilities appropriate resources so that a sound educational experience can occur, including access to patients at Facility in an appropriately supervised environment, and staff required security access.
(b) Facility shall provide adequate training and supervision for Trainees as reasonably necessary for the Facility determines safe, effective operation of the Program consistent with the Program’s objectives and take all reasonable and appropriate necessary safety precautions to provide opportunities a safe environment for educational experience related Trainees. In the event a Trainee is exposed to an infectious or environmental hazard or other occupational injury (i.e. needle stick) while at Facility, the Fieldwork.
b. The Facility will provide a variety such emergency care as is provided its employees, including, where applicable: examination and evaluation by Facility's emergency department or other appropriate facility as soon as possible after the injury; emergency medical care immediately following the injury as necessary; initiation of learning experiences the HBY, Hepatitis C (HCY), and HIV protocol as necessary; and HIV counseling and appropriate testing as necessary. In the event that Facility does not have the resources to provide such emergency care, Facility will refer such student to the settingnearest emergency facility, provided that the Trainee shall retain responsibility for any charges generated.
(c) Facility shall retain full responsibility for all patient care and quality standards, and will maintain a level of care which meets generally accepted standards conducive to satisfactory instruction and for the administrative and professional supervision of Trainees. The experiences and skills taught Trainees shall not be permitted to the Interns shall build upon their academic experience, apply generally to the field of nutrition , replace Facility staff and shall not be specifically limited render unsupervised patient care or services.
(d) Facility will orient each Trainee to all rules, regulations, policies, and procedures applicable to Trainees and shall instruct Trainees as to any emergency procedures, protocol for suspected exposure to blood-borne pathogens, confidentiality, facility care and maintenance, record-keeping, dress code, and any other issues specific to the Facility’s practice or operationlocation.
c. The Facility(e) Facility shall, in coordination with the Academic Fieldwork Coordinatorat its sole cost and expense, will plan procure and implement a/an clinical nutrition education program for the Interns that meets the specific objectives of the clinical experience.
d. The Interns shall not perform routine work such as filing or other clerical work, or otherwise assist in the operations of the Facility.
e. The Interns will not replace, substitute for, or augment the work of paid employees of the Facility. The hours and workload of the Facility’s employees will not be reduced as a result of any Intern’s clinical experience Fieldwork.
f. Each Intern’s clinical experience Fieldwork shall be for a fixed period which shall be established in advance and shall not be extended.
g. The Facility shall not use any Intern’s clinical experience Fieldwork as a trial period to determine whether s/he is suitable for employment. Each Intern will be specifically advised that s/he should have no expectation of being hired by the Facility as an employee.
h. The Facility shall maintain full responsibility for any patient care throughout the term of this Agreement commercial general liability insurance, including contractual liability, and if necessary commercial umbrella insurance, with limits of not less than $1,000,000 per occurrence and $2,000,000 in the Fieldwork.
i. The Facility will allow Interns, at their own expense, to use any available cafeteria and/or snack bar facilities of the Facility.
j. The Facility shall maintain applicable general aggregate and professional liability (Errors & Omissions) insurance coverage on a claims made basis, covering claims made during the policy period and reported within three years of the date of occurrence with limits of liability not less than $1,000,000 per occurrence and $3,000,000 in the aggregate. Notwithstanding the foregoing, if Facility is a public or not-for-profit institution, Facility shall provide evidence of alternate insurance acceptable to University. Such insurance shall be provided by a carrier licensed to do business in Idaho or a funded self-insurance program. Upon execution of this Agreement, Facility shall deliver to the University completed certificate(s) of insurance evidencing such amount and under such terms as may be coverage. Facility shall also maintain all statutorily required by applicable law and shallworker’s compensation coverages.
(f) Facility, upon requestthrough its Liaison, shall cooperate with University in the evaluation of ▇▇▇▇▇▇▇’s work, provide copies reasonable information requested by University on Trainee’s work performance, and provide University with timely notification of certificates of such insurance coverage to the Collegeany significant problems regarding any Trainee or Program.
k. The (g) Facility will provide shall have the right to request immediate removal of any Trainee whose performance is a detriment to Facility’s business or arrange for emergency health care to Interns in case of accident or sudden illness occurring at the Facility, at the expense achievement of the Intern.
l. The Facility shall arrange for and provide close supervision of Interns by persons designated by the Facility who have the requisite knowledge and experience to supervise students in the Dietetic Internship program.
m. The Facility shall advise the College of changes in personnel, operation or policies which materially relate to the Fieldwork and/or an Intern’s participation.
n. The Facility will provide the College and all Interns with copies of, or other reasonable access to, the Facility’s current policies and procedures with which Interns must comply.
o. The Facility will provide Interns with an appropriate orientation, which includes training on HIPAA privacy policies and procedures with respect to protected health information.
p. The Facility will allow on-site visits by College representatives upon prior notice during normal working hours. The Facility will permit reasonable inspection by organizations and individuals responsible for accrediting or regulating the College and will cooperate in supplying non-privileged information reasonably required to assist the College in maintaining accreditation.
q. The Facility may immediately suspend, and/or require the College to withdraw, any Intern from the Fieldwork if, in the discretion stated objectives of the Facility, the Intern poses a risk of harm to the Facility’s patients, employees, contractors, visitors, or other Interns. If reasonably possible, such suspension or withdrawal will be implemented cooperatively by the Facility and the CollegeProgram.
r. The Facility will evaluate the performance of Interns at least two times during the clinical rotation (preferably at the midpoint of the rotation and during the final week), and will return the completed written evaluation to the College within one week of the end of the affiliation.
s. The Facility will provide ongoing opportunities for formal and informal verbal feedback to the Interns regarding clinical performance.
t. The Facility will notify the College when student’s clinical performance is deficient and is not improving or when the student’s level of performance may result in safety concerns for patient care.
u. The Facility will provide the College with information/forms as required by the College and the New York State Education Department, and any applicable accreditation council for the Interns’ field of education.

FACILITY RESPONSIBILITIES. a. The Facility will make available FACILITY agrees to Interns provide student access to its facilities and staff as appropriate for the Facility determines reasonable and appropriate operation of the program. In addition, the FACILITY agrees to provide opportunities student access to available educational and instructional materials in its library if applicable. Students will have the status of trainees at the FACILITY. Students are not to replace FACILITY staff and are not to render client/patient care and/or service except as such are identified for educational experience related value as part of the jointly planned education program, all under the supervision of a professional practitioner who is a member of the staff of the FACILITY and/or ACHE. Consistent with the foregoing, students are not to participate in direct client/patient care activities without the Fieldwork.
b. authorization of the supervisor. Students will be identified as such to all clients/patients and will not participate in care if the client/patient objects to such participation. It is understood that the clinical education program will not interfere with the primary mission of the care and treatment of the client/patient, which shall at all times remain the responsibility of the FACILITY. If appropriate facilities and services are available, the FACILITY will be responsible for providing emergency care for student illness or accident occurring on the FACILITY’S premises during the course of a clinical assignment, but the FACILITY is not responsible for the cost of such care. ACHE will endeavor to assure that medical insurance coverage for students is in effect during their period of assignment, but it is understood that students are financially responsible for their own medical insurance and for any medical care they receive at the FACILITY. The Facility FACILITY will provide each student with a variety of learning experiences appropriate clinical education supervisor (i.e. fieldwork educator, clinical instructor, supervisor, mentor, etc.) to whom he/she is responsible during the settingeducation period. The experiences duties of the supervisor (which may be delegated to appropriate individuals) will include: demonstrating a concern for the personal and skills taught to educational development of the Interns shall build upon their academic experience, apply generally to the field of nutrition , and shall not be specifically limited to the Facility’s practice or operation.
c. The Facility, in coordination with the Academic Fieldwork Coordinator, will plan and implement a/an clinical nutrition education student; providing a planned program for the Interns that meets the specific objectives of the clinical experience.
d. The Interns shall not perform routine work such as filing or other clerical workaffiliation, or otherwise assist in the operations of the Facility.
e. The Interns will not replace, substitute for, or augment the work of paid employees of the Facility. The hours and workload of the Facility’s employees will not be reduced as a result of any Intern’s clinical experience Fieldwork.

t. The Facility will notify the College when student’s clinical performance is deficient and is not improving or when the student’s level need and interests; evaluating the student’s performance during the affiliation; communicating with appropriate ACHE faculty and staff to discuss the student’s progress. The FACILITY may request withdrawal of a student from the FACILITY following consultation with appropriate ACHE personnel and the student involved in the action, but notwithstanding the foregoing may always exercise its rights under A7 and/or B5 above. All records kept by the FACILITY relating to a student’s performance may result in safety concerns for patient care.
u. The Facility will provide during the College with information/forms affiliation period shall be made available to the parties hereto and to the student, and not to other persons, as required by the College Family Educational Rights and Privacy Act of 1974, 20 U.S.C. §1212(g). The FACILITY will, on reasonable request, permit the New York State Education Departmentinspection of its facilities, services available for clinical experiences, and any applicable other relevant items pertaining to the learning experiences, by representatives of ACHE and/or third-party agencies charged with responsibility for approval of facilities or accreditation council of curriculum. The FACILITY shall designate and submit in writing to ACHE for review the name and professional and academic credentials of a person to be responsible for the Internsclinical education program. That person shall be called the clinical education supervisor (fieldwork educator, clinical instructor, supervisor, mentor, etc.). The FACILITY shall immediately notify ACHE in writing of any change or proposed change of the clinical education supervisor. The FACILITY will, at commencement of a student’s placement, provide the student with an orientation as to the FACILITY’S rules, regulations and policies, as well as the standards and practices relevant to the placement, as the FACILITY deems necessary. The FACILITY agrees to indemnify, defend and hold harmless ACHE from any and all cost, damages, losses, expenses, including but not limited to attorneys’ field fees, litigation costs, and court costs, arising out of educationor from the acts of negligence or intentional acts, errors or omissions caused by its officers, board members, agents, representatives, or employees. The STUDENTS will follow the policies, procedures, rules and regulations established by the FACILITY during their affiliation in that FACILITY. The STUDENTS will provide their own health insurance coverage for the period of the education experience. The STUDENTS will provide the FACILITY all data and any additional information required by the FACILITY prior to the experience as assigned by the facility and ACHE. The STUDENTS will provide the necessary and appropriate uniforms required but not provided by the FACILITY. The STUDENTS have the right to appeal a decision made by the FACILITY or ACHE which will have adverse effects upon him/her, subject always to the rights of the FACILITY and ▇▇▇▇ expressed at other places in this agreement and to ACHE policies. The STUDENTS must complete any online orientation as requested by the FACILITY prior to their start date. All students must have a current American Heart Association CPR certification.
