Common use of Exclusive Procedure Clause in Contracts

Exclusive Procedure. The grievance procedure set out above shall be exclusive and shall replace any other grievance or complaint procedure for adjustment of any disputes arising from the application and interpretation of this Agreement. The election to proceed to arbitration as provided herein shall constitute a waiver of any and all rights to proceed under any formal or informal dispute resolution procedure provided by the U.S. Department of Labor.
