Common use of Equal Seniority Clause in Contracts

Equal Seniority. If two (2) or more employees, subject to layoff, have equal seniority in a class‌ 18 then the determination as to who shall be laid off shall be made on the basis of earliest hire date 19 in any classification. If seniority is still equal, the determination shall be made by lot with the 20 affected employees present.
