Common use of Duty to Inspect Clause in Contracts

Duty to Inspect. Licensee acknowledges and agrees that Utility does not warrant the condition or safety of Utility’s Facilities, or the premises surrounding the Facilities, and Licensee further acknowledges and agrees that it has an obligation to inspect Utility’s Poles and/or premises surrounding the Poles, prior to commencing any work on Utility’s Poles or entering the premises surrounding such Poles.

Duty to Inspect. Licensee acknowledges and agrees that the Utility does not warrant the condition or safety of the Utility’s Facilities, or the premises surrounding the Facilities, and Licensee further acknowledges and agrees that it has an obligation to inspect Utility’s Utility Poles and/or premises surrounding the Poles, prior to commencing any work on Utility’s Utility Poles or entering the premises surrounding such Poles. Licensee’s responsibility is limited only to the extent necessary to perform Licensee’s work.
