Duty to Inspect Sample Clauses

Duty to Inspect. You shall inspect all transaction history, reports, journals, and other material evidencing the output of the service(s) performed by Bank. You must report all errors to the Bank for services performed and indicated in the transaction history, reports, journals, and other material evidencing the output of the service(s) or otherwise reported to you daily by the close of business on the banking day following the day on which the Service(s) is rendered. You must report all other errors within a reasonable time not to exceed sixty (60) days from the date that the error is made. Your Failure to promptly report errors within such specified time shall preclude you from asserting against the Bank any claims arising from the error or any loss caused by the error.

Duty to Inspect. Licensee acknowledges and agrees that CPS Energy does not warrant the condition or safety of CPS Energy’s Facilities or the premises surrounding the Facilities, and Licensee further acknowledges and agrees that it has an obligation to inspect Poles, and/or premises surrounding the Poles prior to commencing any work on Poles or entering the premises surrounding the Poles.
Duty to Inspect. Licensee acknowledges and agrees that Utility does not warrant the condition or safety of Utility’s Facilities, or the premises surrounding the Facilities, and Licensee further acknowledges and agrees that it has an obligation to inspect Utility’s Poles and/or premises surrounding the Poles, prior to commencing any work on Utility’s Poles or entering the premises surrounding such Poles.

You must report all other errors within a reasonable time not to exceed thirty (30) days from the date that the error is made. Failure of you to promptly report errors within such specified time shall preclude you from asserting against the Financial Institution any claims arising from the error or any loss caused by the error.

Duty to Inspect. Licensee acknowledges and agrees that District does not warrant the condition or safety of Utility Facilities, or the premises surrounding the Utility Facilities, and Licensee further acknowledges and agrees that it has an obligation to inspect Poles and/or premises surrounding the Poles prior to commencing any work on Poles or entering the premises surrounding such Poles. Licensee’s responsibility is limited only to the extent necessary to perform Licensee’s work. Any obligation of District with respect to the condition or safety of its facilities separate from this Agreement shall remain solely the obligation of the District.
Duty to Inspect. Member is responsible for monitoring all Services provided by Navigant, including each individual transaction processed by Navigant, and notifying Navigant of any errors or other problems within ten (10) Calendar Days (or such longer period as may be required by applicable law) after Navigant has made available to Member any report, statement or other material containing or reflecting the error, including an Account analysis statement or Internet Account access. Except to the extent required by law, failure to notify Navigant of an error or problem within such time will relieve Navigant of any and all liability for interest upon correction of the error or problem (and for any loss from any subsequent transaction involving the same error or problem). In the event Member fails to report such error or problem within thirty (30) Calendar Days (or such longer period as may be required by applicable law) after Navigant made available such report, statement or Internet Account access, the transaction shall be deemed to have been properly authorized and executed, and Navigant shall have no liability with respect to such error or problem.

Duty to Inspect. Contractor shall inspect all Contract Documents, tests and reports, including soil tests and engineering tests, if applicable, and shall conduct a site or field review prior to executing the Contract. Contractor assumes the risk of all conditions which are disclosed, or which are reasonably suggested by any such tests or reports, or which would be disclosed by a field or site review. Contractor shall have the affirmative duty to advise the County of any concerns which Contractor may have regarding construction conditions prior to executing the Contract.
