Common use of Driver Discipline Clause in Contracts

Driver Discipline. Driver Discipline. No driver shall be disciplined, reprimanded, or reduced in compensation without just cause. Any disciplinary action shall be handled in a professional manner and in private. The driver is entitled to, upon request, Union representation at each step. Any disciplinary action may be challenged through the Grievance Procedure found in Article 6 of the Master Agreement between the parties. The employer has seven (7) work days after they have knowledge or reasonably should have known of a violation or misapplication of any act that warrants disciplinary action to notify driver of potential disciplinary action. It is agreed that there may be situations where an investigation after the initial meeting with the driver may require more than seven (7) work days, in such situations the administration can request an extension to complete their investigation to determine whether disciplinary action will be taken.
