Construction; References; Captions Since the Parties or their agents have participated fully in the preparation of this Agreement, the language of this Agreement shall be construed simply, according to its fair meaning, and not strictly for or against any Party. Any term referencing time, days or period for performance shall be deemed calendar days and not work days. All references to Consultant include all personnel, employees, agents, and subconsultants of Consultant, except as otherwise specified in this Agreement. All references to City include its elected officials, officers, employees, agents, and volunteers except as otherwise specified in this Agreement. The captions of the various articles and paragraphs are for convenience and ease of reference only, and do not define, limit, augment, or describe the scope, content or intent of this Agreement.
THE SECOND SCHEDULE ABOVE REFERRED TO (UNIT) All That the Residential Flat / Apartment bearing No. containing a Carpet Area of Square Feet [Built-up Area whereof being Square Feet (inclusive of the area of the balcony(ies) / verandah(s) being Square Feet more or less) and Chargeable Area being Square Feet, which is inclusive of pro rata share in the Common Areas and Installations] more or less, With the Store Room bearing No. containing a Carpet Area of Square Feet [Built-up Area whereof being Square Feet and Chargeable Area being Square Feet, which is inclusive of pro rata share in the Common Areas and Installations] more or less, both on the floor of the Block at the said Premises described in the First Schedule hereinabove written and shown in the Plan annexed hereto, duly bordered thereon in “Red”. With exclusive right to use the Open Private Terrace attached to the said Apartment, containing an area of Square Feet, and shown in the Plan annexed hereto, duly bordered thereon in “ ”. Tariff References 3.5.1 References to state tariffs throughout this Agreement shall be to the currently effective tariff for the state or jurisdiction in which the services were provisioned; provided however, where certain AT&T-22STATE services or tariff provisions have been or become deregulated or detariffed, any reference in this Agreement to a detariffed or deregulated service or provision of such tariff shall be deemed to refer to the service description, price list or other agreement pursuant to which AT&T-22STATE provides such services as a result of detariffing or deregulation.

Product References a. “Or Equal” In all Solicitations or Bid Specifications, the words “or equal” are understood to apply where a copyrighted, brand name, trade name, catalog reference, or patented Product is referenced. References to such specific Product are intended as descriptive, not restrictive, unless otherwise stated. Comparable Product will be considered if proof of compatibility is provided, including appropriate catalog excerpts, descriptive literature, specifications and test data, etc. The Commissioner’s decision as to acceptance of the Product as equal shall be final.
Technical References Technical References that describe the practices, procedures and specifications for certain services (and the applicable interfaces relating thereto) are listed on Schedule 2.3 (the “Technical Reference Schedule”) to assist the Parties in meeting their respective responsibilities hereunder.
Customer Reference Customer agrees that Dynatrace may reference Customer as a Dynatrace customer, subject to Customer’s trademark and logo usage guidelines provided by Customer, and that occasionally, after Customer review, Dynatrace may issue a press release and case study.
