District Responsibilities. Districts will provide special education and related services to students who are eligible for special education under IDEA. Accordingly, Districts will align practices with requirements of federal and state law and regulations concerning the education of children with disabilities, as well as with the Mountain BOCES Special Education Manual and Comprehensive Plan. To ensure this alignment with Mountain BOCES, Districts will: 1. Use the Mountain BOCES website, ▇▇▇.▇▇▇▇▇▇▇▇.▇▇▇, as a point of reference for information needed to maintain coordinated implementation of services 2. In the context of Section D of the MOU, work with the support of Mountain BOCES in the administration and provision of all special education programs and services to ensure adequate staff and support for students with special needs. 3. With the support of Mountain BOCES, manage Child Find and special education service provision in schools that have been chartered by the District as addressed in the individual district/charter school contract and MOU, including Child Find requests, special education services, evaluation of programming, staff qualifications, and staffing patterns 4. Implement the Part C Child Find MOU as it pertains to Part C Child Find evaluations and the transition of students from Part C to Part B services 5. Provide special accommodations under Section 504 of the Rehabilitation Act of 1973 (504) and the Americans with Disabilities Act (ADA), including but not limited to the development and implementation of a formal 504 Plan for any student who is eligible and requires such a plan. 6. Work with Mountain BOCES to periodically evaluate special education programs and services provided in the District, per the requirements of the CDE Comprehensive Plan 7. Work with Mountain BOCES to periodically review the staffing allocation process in the District and assure that it aligns with the Mountain BOCES identified process per the requirements of the CDE Comprehensive Plan 8. Hire, supervise, and evaluate adequately licensed (highly qualified and fully qualified) staff who serve children at the District level 9. Provide input into the performance appraisals of Mountain BOCES staff working in the District 10. Use the IEP system to provide Mountain BOCES with official copies of each Individualized Education Plan (“IEP”) pertaining to each eligible student enrolled in the District in a timely manner as required by state and federal law 11. Participate in the Mountain BOCES-wide process established for protecting privacy of student records when transferred to Mountain BOCES via electronic medium and properly maintain and protect the privacy of student records in District possession 12. By the deadline established in the Tiered Service Model (see Addendum), provide written notice of intent to change participation in any Mountain BOCES program or contract service for the following school year 14. Demonstrate Maintenance of Effort (MOE) as required under federal regulations and supply Mountain BOCES with all needed documentation for MOE (see Section F Fiscal Responsibilities)

District will compensate MAO the aggregate sum of Thirty-Five Thousand Dollars ($35,000.00) for Athletic Training Services provided to Andover High School each year during the term of the contract. Payments of Seventeen Thousand Five Hundred Dollars ($17,500.00) each are due before September 1st and March 1st of the contract term. b. District shall distribute a copy of the MAO Athletic Trainer Privacy Policy Notice to Student Athletes, in the individual district/charter school contract form attached hereto as Exhibit A (the “Privacy Notice”), to all High-School Athletes participating in student athletics and, further, District shall distribute a copy of said document to any ACHS athletes in which an MAO trainer may be present. c. District shall distribute and MOUobtain from each High School Athlete participating in athletic activities associated with the District (i) a signed Authorization for Release of Protected Health Information of Student Athlete Participating in Unified School District 385, including Child Find requestsAndover, special education servicesAthletics Programs, evaluation in the form attached hereto as Exhibit B (the “Authorization(s)”) and (ii) a signed Release of programmingMid- America Orthopedics, staff qualificationsL.L.C. by Student Athlete Participating in Unified School District 385, Andover, Athletics Programs, in the form attached hereto as Exhibit C (the “Release(s)”). District shall promptly provide the original of all such Authorizations and Releases to MAO and shall maintain a copy for its files. Further, District hereby agrees to comply with any and all District obligations set forth in the Authorizations and Releases, if any. d. To supply all materials needed for the Services, including, without limitation, tape, pre-wrap, and staffing patterns 4. Implement other athletic training related supplies agreed upon by the Part C Child Find MOU as it pertains to Part C Child Find evaluations ATC and the transition of students from Part C to Part B services 5. Provide special accommodations under Section 504 of the Rehabilitation Act of 1973 (504) and the Americans with Disabilities Act (ADA), including but not limited to the development and implementation of a formal 504 Plan for any student who is eligible and requires such a planathletic director. 6e. District will name MAO as the sports medicine provider for District high school athletics in printed athletic team publications at no charge to MAO. Work with Mountain BOCES MAO will provide advertisement at MAO cost. f. District will also display MAO banners at all home Andover Central High School contests where coverage by an ATC is provided. It is District’s responsibility to periodically evaluate special education ensure banners are hung in a visible location at each athletic venue. g. District will inform ▇▇▇ of any and all other advertising opportunities when asked. h. District shall timely notify MAO and its ATCs regarding injuries to High School Athletes and give reasonable notice for scheduling in-service programs and services provided or parent counseling. District is under no responsibility or legal liability for failure to notify MAO in cases in which an injury to a High-School Athlete is not readily ascertainable by the District, per the requirements of the CDE Comprehensive Plan. 7. Work i. District is responsible for notifying other participating high schools with Mountain BOCES respect to periodically review the staffing allocation process in the District and assure that it aligns with the Mountain BOCES identified process per the requirements of the CDE Comprehensive Plan 8. Hire, supervise, and evaluate adequately licensed (highly qualified and fully qualified) staff who serve children an event as to whether an ATC will or will not be present due to multiple event coverage at the District level 9host high school. (“IEP”CTC SPED Program Standard 3C.2) 11. Intern Teachers hired within the participating district should be at sites that reflect, to the extent possible, socioeconomic, linguistic and cultural diversity and permit video capture for the Intern Teacher’s reflection. (CTC SPED Program Standard 3C.3) 12. Intern Teachers hired within the participating district should be at sites that allow the Intern Teacher to acquire at least 200 hours of early field experiences that includes guided observations and initial teaching (e.g., co-planning, and co-teaching, or guided teaching) pertaining in the general education and special education settings. (CTC SPED Program standard 3A.12) 13. Intern Teachers hired within the participating district should be at sites that demonstrate a commitment to developmentally and culturally appropriate practices as well as collaborative relationships with families. (CTC SPED Program Standard 3C.1) 14. Assign a qualified Mentor to each eligible student enrolled Candidate within 30 days of enrollment in the District in Program who meets the Commission’s identified criteria of holding a timely manner as required by state valid corresponding Clear or Life Credential, having three (3) years successful teaching experience and federal law 11holds an English learner authorization. Participate in the Mountain BOCES-wide process established for protecting privacy of student records when transferred to Mountain BOCES via electronic medium Pair Candidates with Mentors who most closely match their teaching assignment, including grade level and properly maintain subject matter, and protect the privacy of student records in District possession 12their credential. [Employer might include release time (at the expense of the district) to Part C Child Find evaluations and the transition support participants in required observations (one per semester) and/or observations of students from Part C to Part B servicescolleagues. 5. Provide special accommodations under Section 504 of Utilize defined selection criteria to identify high-quality, experienced teachers who demonstrate exemplary teaching practices as determined by the Rehabilitation Act of 1973 employer to serve as Mentors for Candidates. Mentors must demonstrate effective coaching, interpersonal and communication skills and: ● Display best practices in providing “just in time” (504as needed) and longer-term analysis of teaching practice to help Candidates develop enduring professional skills; ● Commit to attending coaching/Mentor trainings, meetings and to meet weekly with Candidates; ● Display willingness to work collaboratively with colleagues and regional NCSOE staff; ● Embrace a positive attitude and disposition towards students and teaching; ● Develop a sustained and thoughtful collegial relationship with Candidates; ● Demonstrate leadership skills, curriculum expertise, and knowledge of district resources; ● Serve as a role model for the Americans with Disabilities Act (ADA), including but not limited to the development and implementation of a formal 504 Plan for any student who is eligible and requires such a planteaching profession. 6. Work with Mountain BOCES Provide Mentors compensated time to periodically evaluate special education programs and services provided participate in the DistrictProgram Mentor trainings on observation protocol, per learning- focused conversations, “just-in-time” coaching and one-to-one consultations with Candidates(s) as described in the requirements of the CDE Comprehensive PlanDistrict Roles and Responsibilities. 7. Districts will (1) DISTRICT shall ensure that tuition, fees, and refunds are consistent with those disclosed in the DISTRICT’s publications; and (2) DISTRICT shall provide special education all instructional materials for each of the students covered by this agreement; and (3) DISTRICT shall provide or assist with administrative functions, including admissions, counseling, registration, attendance and related services achievement records and other appropriate ancillary and student support services; and (4) DISTRICT shall review and evaluate instruction in the courses to ensure that conduct of these courses meets the standards of the DISTRICT’s regular programs and that students who are eligible engaged in appropriate educational activities and held to an appropriate level of academic rigor; and (5) The DISTRICT shall be responsible for special education under IDEAthe general direction and general supervision of all activities of students and instructors which are performed on the premises of FIRE WARDEN’s Training Center and/or Drill Grounds, and shall coordinate all such activities with Training Officer of FIRE WARDEN so that the students shall be subject to the administrative policies of the Siskiyou County Fire Warden Training Bureau. AccordinglyInstructors shall be subject to policies and procedures governing instruction by DISTRICT; and (6) DISTRICT is responsible for the educational program and shall have the primary right to control and direct the activities of the instructors. DISTRICT shall furnish the instructor(s) provided by FIRE WARDEN with an orientation, Districts will align practices with requirements instructor’s manual, course outlines, curriculum materials, testing and grading rosters and procedures necessary to properly implement the course(s). (7) DISTRICT shall employ all instructors as provided by Section 58058(b) of federal Title 5 of the California Code of Regulations. (8) The DISTRICT course(s) that are the subject of this Agreement have obtained all applicable approvals and state law and regulations concerning are described in the education current college course catalog which is incorporated herein by reference. Nothing in this Agreement requires the DISTRICT to offer DISTRICT courses pursuant to this Agreement. The determination of children with disabilities, as well as whether to offer courses pursuant to this Agreement rests solely with the Mountain BOCES Special Education Manual DISTRICT. (9) Courses shall be provided at DISTRICT or FIRE WARDEN facilities or at appropriate sites identified for approved field trips. Facilities where instruction is provided must be open to the public. All courses shall be open to enrollment by all admitted students in accordance with Title 5 of the California Code of Regulations, sections 51006, 58050, 58051.5, 58012, 58104, and Comprehensive Plan. To ensure 58106. (10) DISTRICT certifies that it does not receive full compensation for the direct education costs of courses provided under this alignment with Mountain BOCESAgreement from any public or private agency, Districts will:individual or group. 1. Use (11) DISTRICT shall collect all applicable enrollment fees, health fees, nonresident tuition, and other student payments required of students enrolled in its credit or non credit courses. (12) The DISTRICT and FIRE WARDEN will work in conjunction to create a list of needed courses by the Mountain BOCES website, FIRE WARDEN and other local agencies each calendar year. (13) Classes scheduled can be viewed at the DISTRICTS website at ▇▇▇.▇▇▇▇▇▇▇▇.▇▇▇, as a point of reference Class Schedule. Courses scheduled will show CRN, course, course title, course description, prerequisite(s), dates, times, location, instructors, certifying agency, enrollment limit and availability, and any material fee (by clicking on the course title). Material fees are only for information needed materials the student will walk away with, i.e. certificates, books, handouts, and any other consumable materials provided to maintain coordinated implementation of services 2. In the context of Section D of the MOUstudent (i.e. rope for Ropes/Knots/Hitches, work with the support of Mountain BOCES in the administration and provision of all special education programs and services others to ensure adequate staff and support for students with special needsbe determined. 3. With (14) The DISTRICT will advertise all fire and EMS classes through the support of Mountain BOCES, manage Child Find and special education service provision in schools that have been chartered by the District as addressed in the individual district/charter school contract and MOU, including Child Find requests, special education services, evaluation of programming, staff qualifications, and staffing patterns 4. Implement the Part C Child Find MOU as it pertains to Part C Child Find evaluations and the transition of students from Part C to Part B services 5. Provide special accommodations under Section 504 of the Rehabilitation Act of 1973 (504) and the Americans with Disabilities Act (ADA), including but not limited to the development and implementation of a formal 504 Plan for any student who is eligible and requires such a planFIRE WARDEN’S office. 6. Work with Mountain BOCES to periodically evaluate special education programs and services provided in the District, per the requirements of the CDE Comprehensive Plan 7. Work with Mountain BOCES to periodically review the staffing allocation process in the District and assure that it aligns with the Mountain BOCES identified process per the requirements of the CDE Comprehensive Plan 8. Hire, supervise, and evaluate adequately licensed (highly qualified and fully qualified) staff who serve children at the District level 9. Provide input into the performance appraisals of Mountain BOCES staff working in the District 10. Use the IEP system to provide Mountain BOCES with official copies of each Individualized Education Plan (“IEP”) pertaining to each eligible student enrolled in the District in a timely manner as required by state and federal law 11. Participate in the Mountain BOCES-wide process established for protecting privacy of student records when transferred to Mountain BOCES via electronic medium and properly maintain and protect the privacy of student records in District possession 12. By the deadline established in the Tiered Service Model (see Addendum), provide written notice of intent to change participation in any Mountain BOCES program or contract service for the following school year 14. Demonstrate Maintenance of Effort (MOE) as required under federal regulations and supply Mountain BOCES with all needed documentation for MOE (see Section F Fiscal Responsibilities)
