Common use of Disposal Facility Clause in Contracts

Disposal Facility. Except as set forth below, all Garbage Collected 933 as a result of performing Collection Services, and Processing Residue shall be transported 934 to, and disposed of, at the Disposal Facility. In the event the Disposal Facility is closed on a 935 Work Day, or is not able to accept Garbage, the CONTRACTOR shall transport and dispose 936 of the Garbage at such other legally permitted Disposal Facility as is approved by TOWN. 937 Failure to comply with this provision shall result in the levy of liquidated damages as 938 specified in Article 19 of this Agreement and may result in the CONTRACTOR being in 939 default under this Agreement.

Except as set forth below, all Garbage Collected 933 Solid Waste (not including 867 residue) collected as a result of performing Collection ServicesServices shall be transported, and Processing Residue shall be transported 934 to868 delivered, and disposed of, at to the Disposal Facility. In the event the Disposal Facility is closed on a 935 Work Day, or is not able to accept Garbage, the 869 CONTRACTOR shall transport and dispose 936 of deliver the Garbage Solid Waste to a fully permitted solid waste 870 facility with notice to the CITY. CONTRACTOR shall be responsible for any increased tipping or 871 gate fees at such other legally permitted Disposal Facility as is approved by TOWNalternative disposal facilities. 937 Failure to comply with this provision shall may result 872 in the levy of liquidated damages as 938 specified in Article 19 20 of this Agreement and may result in the 873 CONTRACTOR being in 939 default under this Agreement.
