Common use of Disposal Facility Clause in Contracts

Disposal Facility. Franchisee shall collect and deliver to Landfill all solid waste, including residential, commercial and industrial solid waste collected in performance of this Agreement which cannot be diverted. Franchisee agrees to indemnify, defend, and hold harmless the City, its officers and employees from any claims arising out of Franchisee’s use of the landfill. Franchisee shall observe and comply with all regulations in effect at the landfill and cooperate with the operator thereof with respect to operations, including directions to unload collection vehicles in designated areas, accommodating construction and maintenance, and hazardous waste exclusion programs. Franchisee shall at all times operate according to safe industry practices. Franchisee shall pay for disposal of solid waste by Franchisee at ▇▇▇▇ ▇▇▇▇▇ Road Landfill unless otherwise mutually agreed in writing by City and Franchisee. Franchisee, shall not, under any circumstances whatsoever, cause to be charged to City the disposal of any material that was collected by Franchisee or by any other person, other than solid waste collected hereunder, without the express prior written authorization of the City representative.
