Common use of DISCHARGING & RE-ENGAGING PERSONNEL Clause in Contracts

DISCHARGING & RE-ENGAGING PERSONNEL. The question of dismissals and re-engagement shall be administered in a fair and just spirit according to seniority of service, but reserving the right to the employer to depart from the rule of seniority of service in circumstances where the employee is incompetent or guilty of misconduct. The above provision shall not apply to the appointment of a manager or cook.
