Common use of Direct Care Clause in Contracts

Direct Care. Contractor’s direct care staff must assist Individuals with activities in Contractor’s facility, as well as activities and medical appointments in the community, and must be trained in accordance with Section 20 of this Exhibit A, Part 1 Statement of Work. For purposes of this Contract, direct care staffing are outlined below: a. Contractor will provide a minimum ratio of 1 staff for every 4 residents during day and evening shifts. Contractor will provide a minimum ratio of 1 staff for every 6 residents during night shift. Contractor will increase staffing when it is warranted by Individual acuity. Upon reaching full capacity under the Contract, Contractor will provide 6 direct care staff during day and evening shifts and 4 direct care staff during night shift; b. In addition to the direct care staffing and regardless of census, Contractor will provide 1 direct care staff on day and evening shifts credentialed as a Certified Medication Aide, with the skills and training necessary to carry out administration of medications to individuals exhibiting challenging behaviors; and c. Contractor will maintain an on-call pool of direct care staff to cover staff absences and position vacancies.

In addition to the above direct care staffing and regardless of censusstaffing, Contractor will shall provide 1 direct care staff FTE medication aide and/ or behavior aide on day and evening shifts credentialed as a Certified Medication Aideeach shift, 7 days per week, with the skills and training in Positive Behavior Supports necessary to carry out administration of behavior plans or administer medications to individuals exhibiting challenging behaviors; andand treatments; c. Contractor will shall maintain an on-call pool of direct care staff to cover staff absences and position vacancies.
