Difference Pay. Each employee shall once each fiscal year be credited with a total of one hundred (100) days sick leave including the sick leave provided under Section 4 of this Article. Each day of sick leave provided by this Section shall be compensated at the rate of fifty (50) percent of the employee’s regular salary. In order to qualify for differential pay, an employee shall first utilize all accumulated sick leave credit, and in no event shall days of differential pay, when combined with days of sick leave utilization, exceed one hundred (100) days in any fiscal year. Only one increment of differential pay shall be allowed for any single and continuous absence that extends into the next fiscal year. Employees receiving difference pay (1/2 pay) may also voluntarily request the use of other accrued time (i.e. vacation or comp-time) to supplement differential pay.

Difference Pay is that pay afforded to a unit member by the Education Code when the unit member is not in a paid status or on a paid leave.
Difference Pay. Any employee who is absent for reason of illness or accident (whether nonindustrial or industrial) after exhaustion of all fully paid leaves to which they are is entitled shall, during the first five (5) months of the absence, receive their regular salary less the amount paid to a person employed as their substitute. The five-month period shall begin on the first day of absence due to illness or injury.

In no case, will the deduction for substitute pay exceed the unit member’s compensation.

Difference Pay. If the employee has utilized all of his/her accumulated sick leave and is absent on account of illness or accident for 100 days or less, then the amount of salary deducted during that period shall not exceed the District’s daily rate for substitutes (first step on salary schedule). It is understood that the District only makes the deduction when a substitute is actually hired. District reserves the right to require medical verification. Consistent with the statute providing this benefit and attorney general opinions interpreting it, the 100-day period commences to run upon the first day of absence due to illness/injury.
Difference Pay. A CDC Teacher who is absent from assigned duties because of an accident or illness, beyond the CDC Teacher’s entitlement to sick leave, for a period of one hundred (100) work days or less, shall have deducted from the salary due the CDC Teacher for that portion of the one hundred (100) day period not covered by sick leave accumulated from prior years of service, the salary paid to the substitute employed to fill the CDC Teacher’s position during the CDC Teacher’s absence, or if no substitute was employed, the minimum salary which would have been paid to the substitute had a substitute been employed. Any portion of a day is to be considered one (1) day.
