Design Error Clause Samples

Design Error. If errors, omissions, ambiguities, inconsistencies, inadequacies or other defects are found in the Contractor’s D ocuments, they and the W orks sha ll be c orrected at the C ontractor’s co st, notwithstanding any consent or approval given by the Employer or the Employer's Representative under this Contract.

This clause is without prejudice to the Employer's right under Sub-Clause 2.5 [Employer's Claim].
