Common use of Delays in the Services Clause in Contracts

Delays in the Services. 29.1 Notwithstanding any provision of this Contract to the contrary, except as otherwise provided by Law, CONTRACTOR shall not be entitled to additional compensation hereunder or to receive damages on account of any hindrances or delays, avoidable or unavoidable; but if any delay is excusable in the reasonable opinion of DCAMM, CONTRACTOR shall be entitled to an extension of time for the Contract Term and the Design/Construction Schedule. The length of the extension shall be sufficient in the opinion of DCAMM, for CONTRACTOR to complete the Services. Although no delay shall increase the Total Contract Value, DCAMM may require that any change in the date by which CONTRACTOR must complete all or any part of the Services be processed on a DCAMM standard Change Order form as set forth in Section 34: Changes in Scope of Services and in Schedule A-5: Instructions/Model Forms.
