Deemed Compliance with Proposition 65. The Parties agree that compliance by Xxxxxxxx with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Third Party with this Agreement constitutes compliance with Proposition 65 with respect to exposure to styrene from use of the Covered Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Belnick with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to BPA from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Leatt with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DINP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Icup with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to Lead from use of the Products.
Deemed Compliance with Proposition 65. Compliance by Enchante with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposures to DEHP in the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Xxxxxxx with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to CrVI from use of the Products. The Parties agree that after the Effective Date, should compliance with Proposition 65 with respect to CrVI from use of the Products be governed by operation of law (i.e., Court Order regarding CrVI in leather products, or other regulatory exemption) Xxxxxxx may choose to comply with such operation of law and such action would not be a breach or violation of this Settlement Agreement.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Home Environment with this Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Yogi with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
Deemed Compliance with Proposition 65. Compliance by Artisan Tropic with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to acrylamide from use of the Covered Products.
