Common use of Contractual Overtime Clause in Contracts

Contractual Overtime. 4 Contractual daily overtime shall be paid to employees who work more than their regularly 5 scheduled workday, inclusive of alternative work schedules, at the Contractual Overtime Rate in 6 effect at the time the overtime work is performed. 7 Contractual weekly overtime shall be paid to employees for all hours worked in excess of 40 8 hours per FLSA workweek at the Contractual Overtime Rate in effect at the time the overtime work 9 is performed. 10 The Contractual Overtime Rate for each overtime hour worked shall be one and one-half 11 times the combined amount of the employee’s hourly base rate of pay and any applicable pay 12 premiums in effect at the time the OT is worked (known as “time and one half”). If the Fair Labor 13 Standards Act (FLSA) requires a higher rate of pay for any overtime hours worked, the employee 14 shall be paid the higher rate of pay pursuant to the FLSA.
