Common use of Continuation of This Agreement Clause in Contracts

Continuation of This Agreement. Temporary transfer of the Resident to another health care facility for medical or surgical treatment, or the Resident’s authorized temporary absence from the Facility for any other purpose shall not terminate this Agreement. Upon the Resident’s return and re-admission in accordance with the admission assessment criteria set by the New York State Department of Health and by the Facility, this Agreement shall continue in full force and effect. Should the Resident subsequently be re-admitted within one (1) year of the initial admission, if a new agreement is not executed, then this Agreement will be deemed to remain in full force and affect for such admission(s) subject to the then applicable daily rate.
