Continuation of This Agreement. Temporary transfer of the Resident to another health care facility for medical or surgical treatment, or the Resident’s authorized temporary absence from the Facility for any other purpose, where such transfer or absence does not exceed a period of sixty (60) days, shall not terminate this Agreement. Upon the Resident’s return and re-admission in accordance with the admission assessment criteria set by the New York State Department of Health and by the Facility, this Agreement shall continue in full force and effect.
Continuation of This Agreement. Upon the Resident’s return and re-admission in accordance with the admission assessment criteria set by the New York State Department of Health and by the Facility, this Agreement shall continue in full force and effect. Should the Resident subsequently be re-admitted within one (1) year of the initial admission, if a new agreement is not executed, then this Agreement will be deemed to remain in full force and affect for such admission(s) subject to the then applicable daily rate.
Continuation of This Agreement. 20.1 Even though interim accounts may be rendered from time to time, this agreement shall continue in force unless and until terminated in accordance with its provisions.
Continuation of This Agreement. 1. This Agreement is guaranteed renewable and may be renewed by payment of the appropriate renewal premium within the grace period.
Continuation of This Agreement. The undertakings in Clauses 3 and 4 of this Agreement shall continue in force indefinitely from the date of this Agreement.
Continuation of This Agreement. The provisions of this Agreement will remain in full effect so far as they remain to be observed and performed after Disposal of the Site provided that none of the Parties shall be entitled to assign the benefit of this Agreement (except to any statutory successor of the Agency or the Council).
Continuation of This Agreement. Notwithstanding the grant and acceptance of the Leases all the provisions of this Agreement shall continue in full force and effect to the extent that they have not yet been fully performed, and shall not merge on the grant of the Leases.
Continuation of This Agreement. Upon the resident’s transfer to an emergency temporary placement, this agreement will remain in force and effect, except for the CFH provider’s responsibility for care to the resident, and the resident’s, or if applicable, the resident’s representative, responsibility to pay the provider for CFH care charges according to Section 2.b of this agreement while the resident is receiving services in another care setting. Upon improvement of the resident’s health or removal of the danger requiring the emergency temporary placement, the resident may return to the home and resume CFH services provided that this agreement has not otherwise been terminated as described in Section 7 of this agreement.
Continuation of This Agreement. Notwithstanding completion of the grant of the Lease and the Operational Agreement such of the provisions of this Agreement as shall not be included in the Lease and the Operational Agreement shall remain in full force and effect and shall be enforceable by and between the Parties.
Continuation of This Agreement. During the period of winding-up and liquidation of the Company, all of the provisions of this Agreement shall continue in effect.
