CONTINGENT TERMS. Subparagraphs A and B to this Section 4 shall commence on February 1, 1997 and shall continue to be effective if and only if the Company is able to meet the Financing Objective. If the Company meets the Financing Objective, subparagraphs C and D to this Section 4 are void and shall not apply. If the Company fails to meet the Financing Objective, then subparagraphs A and B shall terminate and become void on June 1, 1997, and subparagraphs C and D shall become effective on June 1, 1997.
CONTINGENT TERMS. If Optionee elects to exercise this option, the purchase agreement shall further be contingent upon Optionee obtaining rights from both the Iowa Department of Transportation and the South Dakota Railroad to cross their ground and for necessary access permits being granted. It shall also be contingent upon obtaining the necessary zoning approval from any affected municipalities as determined by Iowa law.
CONTINGENT TERMS. You hereby acknowledge that the compensation and benefits that are payable to you on and after the date of your termination of employment with the Company (the "Termination Date") are contingent upon your execution of this Waiver and Release, without which execution you will not be entitled to any of the amounts described in Sections [LIST] of the Service Agreement.
