CONSTRUCTION MANAGER’S PRE-CONSTRUCTION PHASE SERVICES. 5.1 General Coordination.
5.1.1 Construction Manager shall consult with Owner regarding site use and improvements and the selection of materials, building systems, and equipment, and as approved by Einstein Bros Bagels.
5.1.2 Construction Manager shall provide recommendations to the Project Team on: construction feasibility; actions designed to minimize adverse effects of labor or material shortages; time requirements for procurement, installation, and construction completion; assignment of responsibilities for safety precautions and programs; temporary Project facilities; and factors related to construction cost, including estimates of alternative designs or materials, preliminary budgets, and possible cost savings; methods of verification for determining that the requirements and assignment of responsibilities are included in the proposed Contract Documents; and any other matters necessary to accomplish the Project in accordance with the Schedule (as defined below) and Project Construction Budget.
5.1.3 Construction Manager shall develop and update a "Constructability Review" report which is a report resulting from frequent communication with the Project Team and which will outline items that in Construction Manager’s opinion may cause problems in the way the Project is to be constructed and which will review the overall coordination of Specifications and Drawings, details, and discrepancies that if left unattended may result in Change Orders or claims once Project construction commences.
5.1.4 Construction Manager certifies that Design Professional and all other professional service providers have been or will be selected on the basis of competence and qualifications pursuant to Texas Education Code, Section 51.780(f)(1). Throughout the course of this Agreement, Design Professional must be professionally licensed in the State of Texas.
5.1.5 Construction Manager shall cause any architects or engineers retained by Construction Manager to perform any part of the Design Services to: 1) commence performing the Design Services within seven (7) days after execution of this Agreement and upon receipt of payment of Invoice #EBB81-1 of $10,330.00; 2) to perform such services so that the Project shall conform to the Contract Documents; and 3) to complete the various phases of the Project in accordance with the provisions of the Work Progress Schedule.
