The 'Construction and Implementation' clause defines how the terms of the agreement are to be interpreted and put into effect by the parties involved. Construction and Implementation. 5.1 Award the construction contract(s) and submit the Notice(s) to Proceed and awarded contract(s) for the Project to the Grant Manager.
5.2 Construct the Project in accordance with the approved design plans and specifications in Item 4.3 after obtaining environmental clearance in Item 3.1.3 and the necessary approvals, entitlements, or permits in Item 3.2.
5.3 Submit any proposed changes that arise during construction that may affect the Project’s benefits listed in Item 4.2, schedule, or costs to the Grant Manager for approval.
5.4 Submit as-built drawings and a summary of changes from the approved design plans and specifications that occurred during construction to the Grant Manager.
5.5 Prepare an Operations and Maintenance Plan that addresses operation and maintenance of the Project for its useful life and submit to the Grant Manager for approval.
Construction and Implementation. A. Negotiate Energy Performance Contract based upon Investment Grades Audit Agreement to define scope of work with the Public Facility and FCIP.
B. Provide design services.
C. Provide equipment procurement and purchasing.
D. Provide construction and construction management services.
E. Provide hazardous material abatement or disposal.
Construction and Implementation. Construction and/or implementation of each of Project Elements A through C will be undertaken by a contractor or contractors under contract to NMCWD and with construction/implementation oversight and management by the NMCWD Engineer. Construction and implementation will include advance determination of the need for and the procurement of permits and other regulatory approvals necessary for each Project Element, and compliance with all permits and other regulatory approvals, and will give due consideration to wildlife-protection measures recommended by the state Department of Natural Resources.
Construction and Implementation. Construction, equipment procurement, or acquisition costs are not eligible for reimbursement prior to FBA.
6.1 After receiving FBA, award the construction contract(s) and submit the Notice(s) to Proceed and awarded contract(s)for the Project to the Project Manager.
6.2 Submit any proposed changes that arise during construction that may affect the Project’s benefits and components listed in Item 4.2, schedule, or costs to the Project Manager for approval prior to proceeding with the changes.
6.3 Submit the necessary TMF Assessment elements to the Project Manager by the Completion of Construction.
