Condemnation Services. Developer shall retain appropriate consultants to obtain evidence sufficient to demonstrate that the Premises (in its existing state and after the construction of the Building Improvements) is not subject to any pending, threatened or contemplated condemnation, eminent domain or similar proceeding by any Governmental Authority, it being understood and agreed that such work may include solely obtaining written verification from the Owner.

2.1 Right-of-Way Services Management and Supervision
2.1.1 Administer, schedule, and coordinate the following activities necessary to certify that the right-of-way has been acquired and the project is clear for construction letting: meetings, conferences, and communications with the Property Owner(s), the LPA, the Relocatee(s), the Attorney(s), the Engineer(s), the Appraiser(s), the Buying Agent(s), the Relocation Agent(s), the Indiana Department of Transportation (INDOT), and the Federal Highway Administration (FHWA).
2.1.2 Deliver documentation to the LPA so that LPA may make all arrangements to record the conveyance documents, deliver payment to each property owner, and/or to file for condemnation.
2.1.3 Provide the LPA with executed conveyance documents (suitable for recording) and a close out file for each parcel secured through negotiations per the RED Manual.
2.1.4 Provide the LPA with a recommendation for condemnation for each parcel referred to by the LPA for condemnation per the RED Manual.
