Common use of Compensation for default by the Concessionaire Clause in Contracts

Compensation for default by the Concessionaire. Subject to the provisions of Article 22.4, in the event of the Concessionaire being in material breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.

Compensation for default by the Concessionaire. Subject to the provisions of Article 22.4Clause 30.5, in the event of the Concessionaire being in material default or breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach default or defaultbreach, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 Clause 30.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.

Subject to the provisions of Article 22.4Clause 26.3, in the event of the Concessionaire being in material default or breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 Clause 26.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.

Subject to the provisions of Article 22.4Clause 35.6, in the event of the Concessionaire being in material default or breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 Clause 35.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.

Subject to the provisions of Article 22.4Clause 29.4, in the event of the Concessionaire being in material breach or default ordefault of this Agreement, it shall pay shallpay to the Authority by way of compensation, all direct costs suffered directcostssuffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty30(thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation nocompensation shall be payable under this Article 22.1 Clause 29.1 for any material breach or default in respect of which ofwhich Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the consequentiallosses incurredbythe Authority.

Subject to the provisions of Article 22.4Clause 27.5, in the event of the Concessionaire being in material default or breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 Clause 27.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.

Subject to the provisions of Article 22.4Clause 28.5, in the event of the Concessionaire being in material breach or default of this Agreement, it shall pay to the Authority by way of compensation, all direct costs suffered or incurred by the Authority as a consequence of such material breach or default, within 30 (thirty) days of receipt of the demand supported by necessary particulars thereof; provided that no compensation shall be payable under this Article 22.1 Clause 28.1 for any material breach or default in respect of which Damages are expressly specified and payable under this Agreement or for any consequential losses incurred by the Authority.
