COMMON CARRIERS. All shipments will be made using Distributor- --------------- approved carriers, among which includes, without limitation, UPS, USPS and Federal Express. Distributor shall specify by written notice to Xxx.Xxx the carriers that are approved and the types of service to be offered. Distributor shall ship in accordance with the type of delivery specified in each customer's order, or as otherwise specified in the Operations Manual. Any upgrades in shipment from that specified by the customer will be without any additional charge to Xxx.Xxx or the customer. Distributor will also negotiate with each carrier to receive the latest pull times available in order to provide same day shipment on the maximum number of orders.

COMMON CARRIERS. 20.1 Provider hereby acknowledges its obligations under Section 705 of the Communications Act of 1934, as amended, and other applicable federal or state laws not to divulge or publish (except as authorized by law) the existence, contents, substance, purport, effort or meaning of any communications which Provider transmits, receives or assists in transmitting or receiving as part of this Agreement.
COMMON CARRIERS. Whenever AFEM shall deliver or cause to be delivered to a common carrier any products ordered by Distributor, whether or not the particular carrier has been designated in the shipping or routing instructions of Distributor, AFEM shall not be responsible for any delays or damages in shipment, and the common carrier is hereby declared to be the agent of Distributor.

  • Carriers The carriers (including airlines, rail and sea carriers used in association with the tours) are not responsible for statements or features in Tour Brochures. The conditions of sale of each carrier constitute a separate contract between You and the carrier and We have no responsibility in relation to contracts between You and the carriers.

  • Carrier Carrier shall obtain and maintain during the term of this Agreement, at its sole expense, insurance sufficient to cover any and all damages, liability and obligations contemplated by this Agreement. If Carrier’s need for Currency exceeds the insurance limits specified below, Carrier shall increase such limits and provide verification thereof. The coverage by Carrier shall, at a minimum, provide for the following:

  • Passengers THE CARRIER shall be liable for damages resulting from the death of a Passenger or any bodily injury sustained by a Passenger if the act causing the damages took place on board the aircraft or during boarding or deboarding operations.

  • Safety Glasses 10.3.1 Where a teacher is considered to be working in an “eye danger” area, the teacher shall receive a personal issue of standard neutral safety glasses which shall remain the property of the employer.

  • Sprinklers Subject to any terms, conditions and limitations set forth herein, Landlord shall provide an operative sprinkler system consisting of mains, laterals, and heads “AS IS” on the date of delivery of the Premises to Tenant. Tenant shall pay for piping distribution, drops and relocation of, or additional, sprinkler system heads and Building firehose or firehose valve cabinets, if Tenant’s Plans and/or any applicable Laws necessitate such.

  • Visitors Resident will be responsible in all matters regarding this Agreement for the conduct of anyone Resident invites or permits to enter the Residence Facility or its grounds. Any violation of the provisions of this Agreement by such a person will be attributed to Resident and will be grounds for cancellation of this Agreement by College on behalf of Provider, as well as grounds for discipline of Resident by College through its disciplinary process.
