Common use of Commodity Specifications and Standards Clause in Contracts

Commodity Specifications and Standards. The Commodity Specifications and Standards are based on the known needs of Eligible Users and best information available to the Department at the time the Commodity Specifications and Standards were created. The following specifications and standards form a part of the overall Technical Specifications except as modified or noted herein. All Commodities, including all Equipment; Attachments & Accessories; Parts; and their respective features, and components, must individually and jointly comply with the following: All Commodities shall be designed, constructed, equipped, assembled to be fully suitable for their intended use, purpose, and service; All Commodities shall be new and unused for the current Manufacturer’s model year or later, of current or recent production, and of the latest design and construction; All Commodities shall be free of damage and / or rust which may affect appearance, performance or serviceability; All Commodities shall meet the requirements, specifications, terms, and conditions herein. Delivery of non-conforming Commodities, which are not remedied as required herein, may be cause for default proceedings and / or Contract termination.
