Civil Litigation. Construction Manager warrants that it is not plaintiff or defendant in any civil litigation currently pending in the United States and concerning the type of work or services to be performed under this Agreement that would materially impair its ability to perform its obligations under this Agreement. If Construction Manager becomes either a plaintiff or defendant in such civil litigation during the term of this Agreement, Construction Manager will inform Owner as soon as practicable.
