Common use of Chronic Absences for Disability, Illness or Injury Clause in Contracts

Chronic Absences for Disability, Illness or Injury. A regular employee who has chronic disability, illness, or injury, and whose medical prognosis indicates that the employee will be unable to perform the essential functions of their position with reasonable accommodation, may be placed in layoff status from their position. Nothing in this section in any way lessens the Municipality’s obligation to reasonably accommodate an employee’s disability by assignment to another position provided that, with reasonable accommodation, the employee can perform the essential functions of the other position.
