Certain FATCA Information. By its acceptance of its Note, each Noteholder or Note Owner agrees, pursuant to Section 3.3: (A) upon the request of any Paying Agent, to provide the Noteholder Tax Identification Information, and to the extent FATCA Withholding Tax is applicable, Noteholder FATCA Information to the Paying Agent, and (B) that the Paying Agent has the right to withhold any amount of interest (properly withholdable under law and without any corresponding gross-up) payable to such Noteholder or Note Owner that fails to comply with the requirements of (A) above or as may otherwise be required by FATCA.
