Common use of Cancellation by Allottee Clause in Contracts

Cancellation by Allottee. The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellation.

Cancellation by Allottee. The Allottee Allottee(s) shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee Allottee(s) proposes to cancel/withdraw from the project Project without any fault of the promoterPromoter, the promoter Promoter herein is entitled to forfeit the booking amount paid for the allotment. Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is entitled to forfeit deduct 20 % of the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellation.

The balance amount of money paid by the allottee Allottee after the aforesaid deductions shall subject to clause 36.4 below be returned by the promoter Promoter to the allottee Allottee within 45 days of such cancellation.

The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the ActasprovidedintheAct: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, ,the promoter herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellationmoneypaidbytheallotteeshallbereturnedbythepromotertotheallotteewithin45daysofsuchcancellation.

Cancellation by Allottee. The Allottee shall have the right to cancel/withdraw his his/her/their/its allotment in the Project as provided in the Act: Act read with the terms of this Agreement. Provided that where the allottee Allottee proposes to cancel/withdraw from the project Project without any fault of the promoterOwner, the promoter Owner herein is shall be entitled to forfeit the booking amount paid for the allotmentBooking Amount. The balance amount of money paid by the allottee Allottee shall be returned by the promoter Owner to the allottee Allottee within 45 (forty five) days of such cancellation.

Cancellation by Allottee. (i) The Allottee shall have the right to cancel/cancel/ withdraw his allotment in the Project as provided in the Act: Provided that where the allottee Allottee proposes to cancel/withdraw from the project without any fault of the promoter, Promoter the promoter Promoter herein is shall be entitled to forfeit an amount equal to the booking amount paid for the allotmentBooking Amount. The balance amount of money paid by the allottee Allottee shall be returned by the promoter Promoter to the allottee Allottee within 45 (forty-five) days of such cancellation.

The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is hereinis entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellation.

The balance amount of money paid by the allottee Allottee shall be returned by the promoter Owner to the allottee Allottee within 45 days of such cancellation.

Cancellation by Allottee. The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellation only after re-sale of the Unit to another allottee.within 45 days of such cancellation.

Cancellation by Allottee. The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is entitled to forfeit the Five percent booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellationcancellation without any interest.

The balance amount of money paid by the allottee Allottee shall be returned by the promoter Owner/Developer to the allottee Allottee within 45 days of such cancellation.

The balance amount of money paid by the allottee Allottee shall be returned by the promoter Developer to the allottee Allottee without interest within 45 (forty five) days of such cancellation.

Cancellation by Allottee. The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the ActAct : Provided that where the allottee proposes to cancel/cancel / withdraw from the project without any fault of the promoterPromoter, the promoter Promoter herein is entitled to forfeit the booking amount paid for the allotmentamount, with applicable taxes. The balance amount of money paid by the allottee shall be returned by the promoter Promoter to the allottee Allottee within 45 days of such cancellationcancellation after the Promoter having entered into a contract for sale of the said Unit with any new buyer or buyers.

The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 90 days of such cancellation.
