CALCULATION OF ACP. The average contribution percentage for a group is the average of the separate contribution percentages calculated for each Eligible Employee who is a member of that group. An Eligible Employee's contribution percentage for a Plan Year is the ratio of the Eligible Employee's aggregate contributions for the Plan Year to the Employee's Compensation for the Plan Year. "Aggregate contributions" are Employer matching contributions (other than qualified matching contributions used in the ADP test under Section 14.08) and employee contributions (as defined in Section 14.03). For aggregated family members treated as a single Highly Compensated Employee, the contribution percentage of the family unit is the contribution percentage determined by combining the aggregate contributions and Compensation of all aggregated family members. If the plans have different plan years, the Plan Administrator shall determine the combined aggregate contributions on the basis of the plan years ending in the same calendar year. If the Employer treats two plans as a unit for coverage or nondiscrimination purposes, the Employer shall combine the plans to determine whether either plan satisfies the ACP test. This aggregation rule applies to the contribution percentage determination for all Participants, irrespective of whether a Participant is a Highly Compensated Employee or a Nonhighly Compensated Employee.
