Bid Process. The Consultant and the agents and employees of the Consultant acknowledge that they may be excluded in any resulting competitive (or noncompetitive) bid and award process for the supply of goods or services specified as a result of this agreement.
Bid Process. Instructors released on a full-time basis shall have priority over the available training dates according to their seniority. Extra training dates added during a month shall be assigned first to instructors released on a full-time basis and who have not reached their hourly maximum for that month, and this, in reverse order of seniority. Subsequently, if the training needs have not been met using the instructors released on a full- time basis, training dates shall be assigned to the other instructors on the list according to their seniority.

Bid Process. Developer will ask its general contractors and major subcontractors to solicit local contractors and subcontractors to participate in the bid process. For example, to further the objectives of this Section as stated above, Developer will ask its general contractors and major subcontractors to coordinate with any local or regional contractors association to solicit bids from qualified local contractors and subcontractors consistent with this subsection. It is the intent of the parties to include qualified local contractors and subcontractors in the bid process but not to limit participation in the process solely to them nor to prohibit others from participating.

Bid Process. Following Landlord’s approval of the Final Tenant Plans, Landlord shall cause the General Contractor to obtain at least three (3) subcontractor bids for each Major Trade, as hereinafter defined, in connection with the Tenant Improvement Work. “Major Trades” shall be defined as any trade performing work, the cost of which is estimated to exceed $100,000 based upon Landlord’s preliminary price estimates provided pursuant to Section 4.5(D). Tenant shall have the right to propose union subcontractors for each Major Trade and to consult with Landlord and the General Contractor regarding the preparation of the bid packages. Such subcontractors shall be subject to Landlord’s prior consent, which consent shall not be unreasonably withheld, conditioned or delayed. ▇▇▇▇▇▇▇▇’s General Contractor may bid on portions of the Tenant Improvement Plans that would be performed by a subcontractor, such as rough carpentry. Landlord shall prepare an analysis of such bids and recommendations for ▇▇▇▇▇▇’s review. Landlord and Tenant shall pre-approve (which approval shall not be unreasonably withheld) each subcontractor for each trade on the bid list. Except to the extent that ▇▇▇▇▇▇ has expressly disapproved any particular subcontractor, ▇▇▇▇▇▇’s participation in the bid process shall in no way constitute Tenant’s approval or endorsement of any subcontractor(s) or their qualification or ability to perform the subcontract, it being understood that Landlord is ultimately responsible to Tenant for the work performed by the General Contractor and/or any subcontractor(s). The bid packages shall require bidders to identify all Long-Lead Items and to specify delivery dates therefor. ▇▇▇▇▇▇▇▇’s General Contractor, under the direction of Landlord, will solicit the bids from the subcontractors and administer the bid solicitation process in accordance with the time period provided for in Section 4.5(D) below. Upon the conclusion of the bid solicitation process, Landlord will provide Tenant with a copy of the bids received from the subcontractors, including an analysis of such bids and recommendations for Tenant’s review, and meet with Tenant to determine which of the subcontractors shall be awarded the subcontract for each Major Trade within the Tenant Improvement Work. Bid Process. Landlord will cause the Contractor to use commercially reasonable efforts to obtain at least three (3) bids from each qualified subcontractor for subcontracts anticipated to cost in excess of Three Hundred Fifty Thousand Dollars ($350,000.00) (each, a “Major Subcontractor”) in connection with the Landlord’s First Floor Expansion Premises TI Work, and shall share such bids with Tenant promptly after receipt thereof. Without limiting the generality of the foregoing, the selection of subcontractors for the Landlord’s First Floor Expansion Premises TI Work shall be conducted on an “open book” basis as between Landlord, Contractor and Tenant, and Tenant shall have the right to review all bid materials received by Contractor prior to the selection of each Major Subcontractor. Landlord and Contractor shall keep Tenant reasonably informed in the selection of the subcontractors for the Landlord’s First Floor Expansion Premises TI Work, provided that in the event of any disagreement between the parties, Landlord shall have the right, in its sole but reasonable discretion, and acting in good faith, to make all final determinations regarding the choice of each subcontractor.
Bid Process. Fulfilling the staffing of each patrol shift shall be met by posting a “bid” sheet on the Chief’s bulletin board no later than six (6) weeks prior to the beginning of the new schedule year. Employees shall be awarded their shift preference based on seniority established by commission date, with the exception of Evidence Technicians, Canine Officers, and Field Training Officers, whose seniority for shift bidding purposes will be the date upon which he or she began their specialty. If more than one employee has the same commission date or establishment of a specialty position, the employee with the lower department service number (DSN) shall be deemed the senior. If the number of Evidence Technicians or Field Training Officers exceeds the number of positions available, the remaining Evidence Technicians and Field Training Officers will bid for patrol shifts in accordance with their commission seniority date.

Bid Process. Within thirty-five (35) calendar days after Landlord’s receipt of the Construction Plans, Landlord shall submit the Construction Plans to at least two (2) reputable general contractors of Landlord’s choosing and one (1) reputable general contractor of Tenant’s choosing (provided Tenant provides Landlord with the name of a reputable general contractor prior to Landlord receiving the Construction Plans) and shall obtain binding bids (the “Bids”) for the Initial Work. Each of the Bids shall contain: (1) the cost to complete the Initial Work in accordance with the Construction Plans, (2) the period of time to complete the Initial Work in accordance with the Construction Plans and applicable Legal Requirements, and (3) items of the Initial Work which will exceed sixteen (16) weeks to complete. If one or more Bids does not exceed the Maximum Amount (as hereinafter defined) and does not exceed the Maximum Time (as hereinafter defined), then Landlord shall immediately select the lowest responsible and responsive bidder. If all of the Bids state that (A) the cost to complete the Initial Work would exceed [* * *], or such lesser amount if any portion of the Construction Allowance has been used or is earmarked to be used for Soft Costs (as hereinafter defined) (the “Maximum Amount”), or (B) the time to complete the Initial Work would exceed sixteen (16) weeks (the “Maximum Time”), then Landlord shall so notify Tenant that the Bids either exceed the Maximum Amount and/or exceed the Maximum Time (the “Bid Notification”). Within five (5) calendar days after Tenant’s receipt of the Bid Notification, Tenant shall notify Landlord that it (a) approves the costs of the Initial Work that exceeds the Maximum Amount (the “Excess Costs”), in which event Tenant shall be responsible to pay the Excess Costs, to be paid as hereinafter provided, and/or (b) approves the time to perform the Initial Work beyond the Maximum Time (the “Excess Time”), in which event the Excess Time shall be added onto the Initial Work Completion Date, and/or (c) disapproves the Bids and elects to modify the scope of work and/or materials to be used in order to reduce the cost of the Initial Work and/or to reduce the time to complete the Initial Work, in which event, Tenant shall, together with such notice, submit its requests for changes to the Final Plans for Landlords review and approval (which approval shall not be unreasonably withheld, delayed or conditioned) and, upon Landlord’s approval (or deemed a...
