Common use of BID EVALUATION AND AWARD Clause in Contracts

BID EVALUATION AND AWARD. The Consultant shall assist the City in evaluation of bids, determining the responsiveness of bids and the preparation of documents for Award of a contract. If the lowest responsive Base Bid received exceeds the Total Allocated Funds for Construction, the City may: Approve an increase in the Project cost and award a Contract; Reject all bids and re-bid the Project within a reasonable time with no change in the Project or additional compensation to the Consultant; Direct the Consultant to revise the scope and/or quality of construction, and rebid the Project. The Consultant shall, without additional compensation, modify the Construction Documents as necessary to bring the Probable Construction Cost based on such revisions within the Total Authorized Construction Budget. The City may exercise such option where the bid price exceeds 10% of the Fixed Construction Budget provided to the Consultant and as may be modified by the City and the Consultant prior to soliciting bids. Suspend, cancel or abandon the Project.
