Common use of Bespoke development Clause in Contracts

Bespoke development. The Client may request FMIS to undertake bespoke development to enhance The Software. Any such development work will be subject to the following: a. An estimate will be provided for the development work required. Estimates are based on the understanding of the requirements at the time they are provided and are subject to confirmation of fees when the specification is agreed. This initial estimate may be included in the Quotation. b. If detailed specification reveals additional or more complex work, over and above the Quotation, FMIS reserves the right to amend the Quotation accordingly. c. Any later omissions or changes to an agreed specification may be subject to additional charges d. All agreed bespoke development costs are subject to an Annual Maintenance Charge, which is 20% of the cost of development, or as otherwise agreed. This will be charged initially on a pro-rata basis until the renewal date and then added to the Annual Maintenance Charge fee to retain the one renewal date.
