Common use of Arbitration Hearing and Costs Clause in Contracts

Arbitration Hearing and Costs. To the extent consistent with the terms of this Agreement, the arbitrator shall schedule and conduct the hearing in accordance with the Rules of FMCS. The losing party shall pay the costs and fees of the arbitrator. Fees charged for postponement, unilateral withdrawal, or cancellation shall be borne by the party initiating such action. Each party shall be responsible for the costs of presenting its case.
