Common use of APPLICATION/SCOPE Clause in Contracts

APPLICATION/SCOPE. This clause regulates the settlement of all disputes that may arise between the Parties during the Concession and those related to the resolution of the Concession Agreement. The decisions of Regulators or other Competent Government Authorities issued in exercise of their administrative powers attributed by express rule, whose way of claiming is the administrative route, may not be matters of direct negotiation or arbitration.

APPLICATION/SCOPE. This clause regulates the settlement solution of all disputes those controversies that may arise are generated between the Parties parties during the Concession and those related to the resolution termination of the Concession AgreementContract. The decisions of the Regulators or other Competent Government Governmental Authorities issued in exercise of their administrative powers attributed by express rule, whose way of claiming is the administrative route, may not be matters subject matter of direct negotiation or arbitration, which are dictated in execution of their administrative competences attributed by express regulation, which path is the administrative claim.
