• NOW IT IS HEREBY AGREED as follows:

• Masculine or Feminine Gender Unless otherwise specifically stated, any provision in this Agreement which is expressed in terms of the masculine shall, in its application to a female employee, be read with the necessary changes to express the feminine, and vice versa.

• Consultant Compensation F.1 The Consultant’s firm will be compensated for professional services as indicated in the Notice of Project Award in accordance with the fee proposal submitted by the Consultant and negotiated and/or accepted by the Owner. The Owner will compensate the Consultant in accordance with the following terms and conditions:

• Context The Department of Education is Western Australia’s largest public sector employer with approximately 45,000 staff or one third of the Government workforce in around 800 worksites. We provide a system of public schools in which our aim is to ensure that every school is a good school, every teacher is effective and every student is successful. The Department's other key responsibilities include: • regulation of non-government schools in accordance with Part 4 of the School Education Act 1999 • administration of state funding to non-government schools • higher education policy and planning • legislative reviews • providing Secretariat services to the Teachers Registration Board of Western Australia, the Training Accreditation Council and the School Curriculum and Standards Authority. • Background and Context 1.1 Objectives of this Agreement The purpose of this Agreement is to define, in the context of the resource inputs provided, the targets by which the performance of Forensic Science Ireland (FSI) will be measured in 2021. The ongoing supports that the Department of Justice will provide to FSI in this regard, and the mechanisms for monitoring and appraising performance, form part of the overall governance arrangements between the two parties and as such are set out in the separate but complementary Oversight Agreement 2020-22.

• INCOME NOT EXPRESSLY MENTIONED Items of income of a resident of a Contracting State which are not expressly mentioned in the foregoing Articles of this Agreement shall be taxable only in that Contracting State except that if such income is derived from sources in the other Contracting State, it may also be taxed in that other State.

• Domestic Partners; Spouses; Gender Discrimination If the Contract Amount is $100,000 or more, Contractor certifies that it is in compliance with PCC 10295.3, which places limitations on contracts with contractors who discriminate in the provision of benefits regarding marital or domestic partner status.

• Employees Not Eligible for Holiday Compensation 366. Persons employed for holiday work only, or persons employed on a part-time work schedule which is less than twenty (20) hours in a bi-weekly pay period, or persons employed on an intermittent part-time work schedule (not regularly scheduled), or persons employed on as-needed, seasonal or project basis for less than six (6) months continuous service, or persons on leave without pay status immediately preceding or immediately following the legal holiday shall not receive holiday pay.

• Gender and Number Any reference in this Agreement to gender shall include all genders, and words imparting the singular number only shall include the plural and vice versa.

• GENDER NEUTRALITY 24.01 In this Agreement, any references to the masculine gender shall include the female gender and references to the female gender shall include the masculine gender.
