Amendment to Section 3.9. Section 3.9 of the Credit Agreement is hereby amended in its entirety to read as follows:
Amendment to Section 3.9. Section 39 of the Lease is hereby amended ----------------------- by adding the following at the end thereof:
Amendment to Section 3.9. Section 3.9 of the Credit Agreement is hereby amended by deleting the term “HCLP” in both places in which it appears in subsection 3.9(b) and in each case substituting in lieu thereof the term “the relevant Borrower”.
Amendment to Section 3.9. Section 3.9 of the Stock Purchase ------------------------ Agreement is hereby amended by adding thereto the following provisions immediately after Section 3.9(b):
Amendment to Section 3.9. Section 3.9 of the Credit Agreement is hereby amended and restated as follows: There is no litigation or governmental proceeding or labor controversy pending, nor to the knowledge of HAI or the Borrower threatened, against HAI or the Borrower or any Subsidiary which could reasonably be expected to result in a Material Adverse Effect.
