Common use of Advertising Prohibition Clause in Contracts

Advertising Prohibition. Provider is prohibited from using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, Washington Student Data Privacy Agreement V 1.0 4 advertising, or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Student Data for the development of commercial products or Services, other than as necessary to provide the Service to LEA. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

Advertising Prohibition. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

Provider is prohibited from using or selling Student Data (except as permitted by Provider’s Privacy Policy) to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, Washington Student Data Privacy Agreement V 1.0 4 advertising, or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Student Data for the development of commercial products or Servicesservices, other than as necessary to provide the Service to LEA. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

Provider is prohibited from leasing, renting, using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, Washington Student Data Privacy Agreement V 1.0 4 advertising, advertising or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service Services to LEA; or (d) use the Student Data for the development of commercial products or Servicesservices, other than as necessary to provide the Service Services to LEA. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.

This section does not prohibit Provider from from: (a) using Student Data for adaptive learning or customized student learning purposes, (b) using Student Data to develop or improve Provider’s Internet web sites, online services or mobile applications owned by the Provider or (c) using Student Data to demonstrate the effectiveness of the Provider’s Internet web site, online service or mobile application.

Provider is prohibited from using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, Washington Student Data Privacy Agreement V 1.0 4 advertising, or other commercial advertising efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Student Data for the development of commercial products or Servicesservices, other than as necessary to provide the Service to LEALEA unless it fits into the de-identified information exception in Article IV, Section 4. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.
