Advertising Prohibition. Provider is prohibited from using Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing or advertising efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to Client; or (d) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service to Client.
Advertising Prohibition. Provider is prohibited from using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, advertising, or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service to LEA. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes, as long as such learning purposes are available for use by the LEA.
Advertising Prohibition. Without limiting any other provision in this DPA, Provider is specifically prohibited from using, disclosing, or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, advertising, or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service(s) to School Unit; or (d) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service(s) to School Unit.
Advertising Prohibition. Provider is prohibited from using or selling Division Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing or advertising efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to Client; or (d) use the Division Data for the development of commercial products or services, other than as necessary to provide the Service to Client. This section does not prohibit Provider from generating legitimate personalized learning recommendations or other activities permitted under Code of Virginia § 22.1-289.01.
Advertising Prohibition. The Provider is prohibited from using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, advertising, or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service to LEA. The Provider is also prohibited from mining data for any purpose other than those agreed to by the parties. Data mining or scanning of user content for the purpose of advertising or marketing to students or their parents is prohibited. This section does not prohibit the Provider from using Student Data for adaptive learning or customized student learning purposes.
Advertising Prohibition. Provider is prohibited from using Personally Identifiable Information contained in Student Data to (a) serve Targeted Advertising to students or families/guardians unless with the consent of parent/guardian or LEA; (b) develop a profile of a student for any commercial purpose other than providing the Service or as authorized by the parent/guardian or LEA; or (c) develop commercial products or services, other than as necessary to provide the Service to LEA, as authorized by the parent or legal guardian, or as permitted by applicable law. This section shall not be construed to (i) limit the ability of Provider to use Student Data for adaptive learning or customized student learning purposes (including generating personalized learning recommendations for account holders or sending Program Communications to account holders); (ii) prohibit Provider from using aggregate or De-Identified Data to inform, influence or enable marketing, advertising or other commercial efforts by Provider, (iii) prohibit Provider from marketing or advertising directly to parents or other users so long as the marketing or advertising did not result from the use of Personally Identifiable Information contained in Student Data obtained by Provider from providing the Services;
Advertising Prohibition. Provider is prohibited from using Personally Identifiable Information contained in Student Data to (a) serve Targeted Advertising to students or families/guardians unless with the consent of parent/guardian or LEA; (b) develop a profile of a student for any commercial purpose other than providing the Service to LEA or as authorized by the parent/guardian or LEA; or (c) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service to Client, as authorized by the parent or legal guardian, or as permitted by applicable law. Personally Identifiable Information contained in Student Data should never be used or disclosed for Third-Party Advertising (as defined in Exhibit C). Additionally, Provider does not allow Third-Party Advertising on its Service in user logged in areas of the Service. This section shall not be construed to (i) prohibit Provider from marketing or advertising directly to parents or other users so long as the marketing or advertising did not result from the use of Personally Identifiable Information contained in Student Data obtained by Provider from providing the Services; (ii) apply to the marketing of school memorabilia such as photographs, yearbooks, or class rings, (iii) prohibit Provider from using aggregate or De-Identified Data to inform, influence or enable marketing, advertising or other commercial efforts by Provider, (iv) limit the ability of Provider to use Student Data for adaptive learning or customized student learning purposes, (v) prohibit Provider from using Student Data to recommend educational products or services to parents/guardians, students, or LEAs so long as the recommendations are not based in whole or part by payment or other consideration from a third party, (vi) prohibit Provider from using Student Data with parent/guardian consent to direct advertising to students to identify higher education or scholarship providers that are seeking students who meet specific criteria.
Advertising Prohibition. Provider is prohibited from leasing, renting, using or selling Student Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, advertising or other commercial efforts by a Provider; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA, or in furtherance of K-12 school purposes; or (d) use the Student Data for the development of commercial products or services, other than as necessary to provide the Service to Client, or in furtherance of K- 12 school purposes.
Advertising Prohibition. Operator is prohibited from using or selling Data to (a) market or advertise to students or families/guardians; (b) inform, influence, or enable marketing, advertising, or other commercial efforts by a Operator; (c) develop a profile of a student, family member/guardian or group, for any commercial purpose other than providing the Service to LEA; or (d) use the Data for the development of commercial products or services, other than as necessary to provide the Service to LEA. This section does not prohibit Operator from generating legitimate personalized learning recommendations.
Advertising Prohibition. This section does not prohibit Provider from using Student Data for adaptive learning or customized student learning purposes.
