Common use of Adjacent Excavation-Shoring Clause in Contracts

Adjacent Excavation-Shoring. If any excavation or other sub-structural work shall be made upon land adjacent to the Building or the Property or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation or other sub-structural work license to enter upon the Premises for the purpose of doing such work as said person shall deem necessary to preserve the walls or structures of the Building of which the Premises form a part from injury or damage and to support the same by proper foundations without any claim for damages or indemnity against Landlord, or diminution or abatement of rent.

Adjacent Excavation-Shoring. 13.01. If any an excavation or other sub-structural substructure work shall be made upon land adjacent to the Building or the Property demised premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation or other sub-structural work excavation, license to enter upon the Premises demised premises for the purpose purposes of doing such work as said person shall deem be necessary to preserve the walls wall of or structures of the Building of which the Premises demised premises form a part from injury or damage and to support the same by proper foundations without any claim for damages or indemnity against Landlord, or diminution or abatement of rent.

If any an excavation or other sub-structural work shall be made upon land adjacent to the Building or the Property Demised Premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation or other sub-structural work excavation, provided, that such person compiles with all applicable requirements of law, a license to enter upon the demises Demised Premises for the purpose of doing such work as said person shall deem necessary to preserve the walls wall or structures of the Building of which the Premises Demised premises form a part from injury or damage and to support the same by proper foundations without any claim for damages or indemnity against Landlord, or diminution or abatement of rent.
